I transmit for the approval of the Senate an informal convention with the Republic of Venezuela for the adjustment of claims of citizens of the United States on the Government of that Republic, growing out of their forcible expulsion by Venezuelan authorities from the guano island of Aves, in the Caribbean Sea. Usually it is not deemed necessary to consult the Senate in regard to similar instruments relating to private claims of small amount when the aggrieved parties are satisfied with their terms. In this instance, however, although the convention was negotiated under the authority of the Venezuelan Executive and has been approved by the national convention of that Republic, there is some reason to apprehend that, owing to the frequent changes in that Government, the payments for which it provides may be refused or delayed upon the pretext that the instrument has not received the constitutional sanction of this Government. It is understood that if the payments adverted to shall be made as stipulated the convention will be acceptable to the claimants.

I transmit to the Senate for its consideration, with a view to ratification, a treaty of peace, friendship, commerce, and navigation between the United States and the Republic of Bolivia, signed by their respective plenipotentiaries, at La Paz, on the 13th of May, 1858.

The treaty of peace, commerce, and navigation between the United States and the Republic of Bolivia, signed at La Paz on the 13th day of May, 1858, was read the first time.

On motion by Mr. Mason,

Ordered, That the said treaty, together with the message of the President, be referred to the Committee on Foreign Relations and printed in confidence for the use of the Senate.

On motion by Mr. Mason,

Ordered, That the convention, together with the message of the President and accompanying documents, be referred to the Committee on Foreign Relations, and printed in confidence for the use of the Senate. Mr. Gwin, from the Committee on Finance, to whom was referred, the 7th inst., the nomination of George W. Rowles, reported.

Whereupon

Resolved, That the Senate advise and consent to the appointment of George W. Rowles, agreeably to the nomination.

Mr. Mason, from the Committee on Foreign Relations, to whom were referred, December 21st, the special convention between the United States of America and the Republic of Paraguay, relating to the claims of the "United States and Paraguay Navigation Company" against the Paraguayan Government, concluded at Assumption, the 4th day of February, 1859, reported it without amendment.

Mr. Mason, from the Committee on Foreign Relations, to whom was referred, December 21st, the treaty of friendship and cominerce between

the United States and Nicaragua, signed at Managua on the 16th day of March 1859, reported it without amendment.

Mr. Clay, from the Committee on Commerce, to whom were referred, the 7th inst., the nominations of Robert Eager, James S. Whitney, and Robert M. Livingston, reported.

Whereupon

Resolved, That the Senate advise and consent to the appointment of Robert Eager and Robert M. Livingston, agreeably to their nominations respectively.

Mr. Pugh, from the Committee on Public Lands, to whom was referred, January 30th, the nomination of Thomas E. Herbert, reported. Whereupon

Resolved, That the Senate advise and consent to the appointment of Thomas E. Herbert, agreeably to the nomination.

Mr. Gwin, from the Committee on Post-Offices and Post-Roads, to whom were referred, the 7th inst., the nominations of Nathan B. Luse, Joseph H. Richards, Peter Aurand, and Thomas Chalfant, reported. Whereupon

Resolved, That the Senate advise and consent to the appointment of the said persons, agreeably to their nominations respectively.

Mr. Hemphill presented the memorial of the Rio Grande, Mexican and Pacific Railroad Company, praying to be protected in the rights and privileges to which they are entitled under a contract with Mexico, providing for a railway from the Rio Grande to the Pacific.

On motion by Mr. Hemphill,

Ordered, That the said memorial be referred to the Committee on Foreign Relations.

Mr. Brown, from the Committee on the District of Columbia, to whom were referred, the 2d inst., the nominations of Robert White and Thomas H. Lane, reported.

Whereupon

Resolved, That the Senate advise and consent to the appointment of Robert White, agreeably to the nomination.

Mr. Rice submitted the following resolution; which was considered, by unanimous consent, and agreed to:

Resolved, That so much of the treaties made between the United States and the Sioux Indians, June 19th, 1858, as requires further action upon the same, be referred to the Committee on Indian Affairs, and that said committee be instructed to report thereon.

THURSDAY, FEBRUARY 16, 1860.

The special convention between the United States of America and the Republic of Paraguay, relating to the claims of the "United States and Paraguay Navigation Company" against the Paraguayan Government, concluded at Assumption the 4th day of February, 1859, was read the second time and considered as in Committee of the Whole; and no amendment being made, it was reported to the Senate.

Mr. Mason submitted the following resolution for consideration: Resolved (two-thirds of the Senators present concurring), That the Senate advise and consent to the ratification of the special convention between the United States of America and the Republic of Paraguay, relating to the claims of the "United States and Paraguay Navigation Company" against the Paraguayan Government, concluded at Assump

The Senate, by unanimous consent, proceeded to consider the said resolution, and it was unanimously agreed to.

Ordered, That the Secretary lay the said resolution before the President of the United States.

Mr. Johnson, of Arkansas, from the Committee on Public Lands, to whom were referred, January 18th, the nominations of George Helvenston and Isaac W. Smith, and the 2nd instant the nomination of John E. Perkins, reported.
