I submit, for the consideration of the Senate, articles of agreement and convention with the Delaware Indians, concluded May 13th, 1860. I concur in the recommendation of the Secretary of the Interior, that the treaty should be ratified with the amendments suggested by the Commissioner of Indian Affairs.

SIR: I have the honor to submit for your consideration articles of agreement and convention with the Delaware Indians, made and concluded at Sarcoxieville, K. T., on the 13th ulto., together with a copy of the report, with accompanying documents of the Commissioner of Indian Affairs, transmitting the same to this Department.

I have given the subject my attention, and recommend that these articles be laid before the Senate for its constitutional action, with the amendments suggested by the Commissioner, in which I concur, as being eminently proper to carry out the objects of the convention, and more especially that portion which provides for the disposition of their surplus land.

The articles of agreement and convention between Thomas B. Sykes, commissioner on the part of the United States and certain chiefs of the Delaware Tribe of Indians, concluded at Sac-cox-ie-ville, the 13th day of May, 1860, were read the first time.

On motion by Mr. Sebastian,

Ordered, That the said articles of agreement and convention be referred, together with the message of the President and the accompanying documents, to the Committee on Indian Affairs and printed in confidence for the use of the Senate.

Mr. Yulee, from the Committee on Post-Offices and Post-Roads, to whom was referred, the 8th inst., the nomination of Henry C. Street, reported.

Whereupon

Resolved, That the Senate advise and consent to the appointment of Henry C. Street, agreeably to the nomination.
