To the Senate of the United States:

I have received the resolution of the Senate, of the 24th instant, requesting the return to that body of the convention between the United States and the Republic of Venezuela on the subject of the Aves Island. That instrument is, consequently, herewith returned. It was approved by the Senate on the 24th June last, with the following amendment: "Article III. Strike out this article in the following words:

"In consideration of the above agreement and indemnification, the Government of the United States, and the individuals in whose behalf they have been made, agree to desist from all further reclamation respecting the Island of Aves, abandoning to the Republic of Venezuela whatever rights might pertain to them."

The amendment does not seem necessary to secure any right either of the United States or of any American citizen claiming uuder them. Neither the Government nor the citizens in whose behalf the convention has been concluded have any further claims upon the Island of Aves. Nor is it known or believed that there are any claims against the Government of Venezuela having any connection with that island other than those provided for in this convention. I therefore recommend the reconsideration of the subject.

No steps have yet been taken towards making known to the Venezuelan Government the conditional approval of the convention by the Senate. This might have been necessary if the instrument had stipulated for a ratification in the usual form and it had been ratified accordingly. Inasmuch, however, as the convention contains no such stipulation, and as some of the installments had been paid according to its terms, it has been deemed preferable to suspend further proceedings in regard to it, especially as it was not deemed improbable that the Senate might request it to be returned. This anticipation has been realized. JAMES BUCHANAN,

On motion by Mr. Bigler,

Resolved, That the message of the President returning to the Senate the convention between the United States and the Republic of Venezuela on the subject of the Aves Island, together with the convention, be referred to the Committee on Foreign Relations.

Mr. Johnson, of Ark., from the Committee on the District of Columbia, to whom were referred, January 24th, the nominations of Patrick McKenna, George Mattingly, Henry G. Murray, Richard G. Burgess, John R. Queen, Richard R. Shekell, John D. Clark, and John H. Goddard, reported.

Whereupon

Mr. Sebastian, from the Committee on Indian Affairs, to whom were referred, December 17th, the nominations of Albert G. Boone, Matthew Leeper, and Wesley B. Gosnell, reported.

Mr. Lane, from the Committee on Military Affairs and the Militia, to whom was referred, January 17th, the nomination of John C. Bonnycastle, reported.

Resolved, That the Senate advise and consent to the appointment of John C. Bonnycastle, agreeably to the nomination.

Mr. Powell submitted the following resolution; which was considered by unanimous consent, and agreed to:

Resolved, That the Committee on Naval Affairs be instructed to inquire and report to the Senate whether or not Mr. Haswell deserted from the U. S. ship San Jacinto, at Gibraltar, on or about the year 1852 or 1853, and that said committee further inquire into and report to the Senate the cause for which said Haswell was dismissed from the United States Navy.

The Senate proceeded to consider the nomination of Ralph Gurnee; and

Resolved, That the Senate advise and consent to the appointment of Ralph Gurnee, agreeably to the nomination.

The Senate proceeded to consider the nominations of James Taylor, Edward Patch, Alfred Marschner, and Edward Eastman; and

Resolved, That the Senate advise and consent to the appointment of the said persons, agreeably to their nominations respectively.

WEDNESDAY, FEBRUARY 6, 1861.

On motion by Mr. King that the Senate reconsider the vote of the Senate on the 1st inst. advising and consenting to the appointment of Ralph Gurnee,

Ordered, That the further consideration thereof be postponed to to

morrow.

Mr. King submitted the following resolution; which was considered by unanimous consent, and agreed to:

Resolved, That the President of the United States be requested to return to the Senate the nomination of Ralph Gurnee to be collector of the customs for the district of Sackett's Harbor, in the State of New York, in the place of William Howland, removed, whose appointment the Senate advised and consented to on the 6th of February inst.
