to the contrary notwithstanding: Provided alfo, that whatever Monies fhall be afterwards paid by the Bank of England into the faid Receipt in purfuance of this Act, fhall be applied towards re placing the Monies before iffued of the faid Aids or Supplies, or out of the faid Confolidated Fund, as the cafe may be; any Thing herein contained to the contrary notwithstanding.

LXIII. And be it further enacted, That it shall be lawful for the Governor and Company of the Bank of England, to advance or lend to His Majefty in like Manner, at the Receipt of the Exchequer, upon the Credit of any Loan granted by this Act, any Sum or Sums of Money not exceeding in the whole the Sum of Six Millions; any Thing in an Act made in the Fifth and Sixth Years of the Reign of King William and Queen Mary, intituled, An Aa for granting to Their Majeflies feveral Rates and Duties upon Tonnage of Ships and Veffels, and upon Beer, Ale and other Liquors, for fecuring certain Recompences and Advantages in the faid Act mentioned, to fuch Perfons as fhall voluntarily advance the Sum of One Million five bundred thousand Pounds towards carrying on the War against France; to the contrary thereof in any wife notwithstanding.

LXIV. And be it further enacted, That the faid Commiffioners hereby appointed fhall from Time to Time at their Discretion, or as often as they fhall be thereunto required, during their carrying on any Proceedings by virtue of this Act, and as foon as poffible after the Determination of fuch Proceedings, without any further Requifition, give an Account of their Proceedings in Writing to the Lords Commiffioners of His Majefty's Treasury, or the Lord High Treasurer for the Time being.

LXV. And be it further enacted, That if any of the faid Commiffioners appointed by this Act, fhall decline to act in the Execution of the Powers and Trufts hereof, or having begun to act shall decline to act any further therein, or fhall depart this Life during the Continuance of this Act, it fhall be lawful for the remaining Commiffioners, or the major Part of them acting as aforefaid, by any Writing under their Hands and Seals, by and with the Confent and Approbation of the Lords Commiffioners of His Majefty's Treafury, or any Three or more of them, or the Lord High Treasurer for the Time being, to conftitute and appoint fuch Perfon or Per fons to be a Commiffioner or Commiffioners for the Purpose aforesaid, in the Place of the Commiffioner or Commiffioners fo refufing to act, or declining further to act, or dying as aforefaid, as the faid acting Commiffioners, or the major Part of them, with fuch Confent and Approbation as aforefaid, fhall think fit, and fo often as such Cafe hall happen; and the Perfon or Perfons fo conftituted and appointed by the faid Commiffioners, with fuch Confent and Approbation as aforefaid, having firft qualified to act by taking and fubfcribing the Oath hereinbefore provided and directed, fhall be invefted with the fame Powers and Authorities as are given or delegated by this A&t unto the faid Commiffioner or Commiffioners conftituted by this Act refpectively.

LXVI. And be it further enacted, That it fhall be lawful for all Perfons, Bodies Politick or Corporate, advancing any of the Exchequer Bills to be iffued by virtue of this Act, by way of Loan, to any Perfon who may be willing to accept fuch Exchequer Bills, valuing the fame at the Sum which fhall be expreffed therein refpectively,

together

together with fuch Intereft as may have accrued thereon at the Time of advancing fuch Loan, to charge and receive Intereft for such Loan at the Rate of Five Pounds per Centum per Annum; any Law or Ufage to the contrary notwithstanding.

LXVII. And be it further enacted, That the faid Commiffioners Commiffioners fhall and may receive and fend all their Letters and Packets free free of Postage. from the Duty of Poftage; provided that such Letters and Packets as fhall be fent to the faid Commiffioners, be directed to "The Commiffioners for the Iffue of Exchequer Bills at their Office;" and that all fuch Letters and Packets as fhall be fent by them be dated from their faid Office, and fhall be figned on the Outfide of fuch Letters and Packets by fuch Perfon as the faid Commiffioners, with the Confent of the Lords Commiffioners of the Treasury, or any Three or more of them, fhall appoint, (and under fuch Restrictions and Regulations as the faid Commiffioners of the Treasury shall think proper and direct.

LXVIII. And be it further enacted, That any Wares or Mer- Depofit not chandize fold by Public Sale by way of Auction under the Autho- liable to Auction rity of this Act, fhall and may be fold free of the Duty impofed Duty. upon Sales by Auction.

LXIX. And be it further enacted, That no Obligation to His Obligations, &c. Majefty taken by the faid Commiffioners, nor any Heritable Securi- not liable to ties, nor any Alignment of any Heritable Securities taken by the Stamp Duty. faid Commiffioners, or any Promiffory Note to be given to the Secretary to the faid Commiffioners under this Act as a Security for the Loan of Money in fuch Exchequer Bills as aforefaid, nor any Affidavit, Depofition or Receipt taken or to be taken or made under and by virtue of this Act, fhall be liable to any Stamp Duty whatever.

LXX. And be it further enacted, That no Action or Suit fhall Limitation of be commenced against any Perfon or Perfons for any Thing done by Actions. virtue of or in purfuance of this A&t, until Fourteen Days Notice thereof in Writing fhall have been given to the Secretary for the time being of the faid Commiffioners; nor after a fufficient Satisfaction or a Tender thereof hath been made to the Party or Parties aggrieved; nor after Six Calendar Months next after the Fact committed; and every fuch Action fhall be brought in the faid respective Court of Exchequer, and fhall be laid in the County of Middlefex or the City of Edinburgh refpectively, and not elsewhere; and the Defendant or Defendants of fuch Action or Suit fhall and may plead the General Iffue, and give this Act, and the fpecial Matter in Evi- General Iffue. dence, at any Trial to be had thereupon, and that the fame was done in pursuance and by the Authority of this A&; and if the fame fhall appear fo to be done, or if fuch Action or Suit fhall be brought after the time hereinbefore limited for bringing the fame, or fhall be brought without Fourteen Days Notice thereof, or shall be brought in any other County or Place, or after a fufficient Satisfaction made or tendered as aforefaid, that then the Jury fhall find for the Defendant or Defendants; or if the Plaintiff or Plaintiffs fhall become nonfuited or fuffer a Difcontinuance of his, her or their Action or Actions, or if a Verdict fhall pafs against the Plaintiff or Plaintiffs, the Defendant or Defendants fhall have Treble Cofts, and fhall have Treble Cofts, fuch Remedy for recovering the fame as any Defendant or Defendants hath or have for Cofts of Suit in any other Cafes by Law.

LXV. LXVI. And be it further enacted, That it fhall be lawful for all ing Exchequer Perfons, Bodies Politick or Corporate, advancing any of the Exchequer Bills to be iffued by virtue of this Act, by way of Loan, to any Person who may be willing to accept fuch Exchequer Bills, valuing the fame at the Sum which fhall be expreffed therein refpectively,

together with fuch Intereft as may have accrued thereon at the Time of advancing fuch Loan, to charge and receive Interest for such Loan at the Rate of Five Pounds per Centum per Annum; any Law or Ufage to the contrary notwithstanding.

LXVII. And be it further enacted, That the faid Commiffioners Commissioners fhall and may receive and fend all their Letters and Packets free free of Poilage. from the Duty of Poftage; provided that fuch Letters and Packets as shall be sent to the faid Commiffioners, be directed to "The Commiffioners for the Iffue of Exchequer Bills at their Office;" and that all fuch Letters and Packets as fhall be fent by them be dated from their faid Office, and shall be signed on the Outfide of fuch Letters and Packets by fuch Perfon as the faid Commiffioners, with the Confent of the Lords Commiffioners of the Treasury, or any Three or more of them, fhall appoint, (and under fuch Restrictions and Regulations as the faid Commiffioners of the Treafury fhall think proper and direct.

hath or have for Cofts of Suit in any other Cafes by Law.

LXXI. And be it further enacted, That if any Perfon or Perfons fhall forge, counterfeit or alter, or caufe or procure to be forged, counterfeited or altered, or knowingly or willingly act or affift in the forging, counterfeiting or altering any Certificate or Certificates of the faid Commiffioners by this Act appointed as aforefaid, or any of them, or any Receipt or Receipts to be given by the Cashier or Cafhiers of the Bank of England, in purfuance of this A&t; or shall wilfully deliver to the Auditor of the Receipt of His Majesty's Exchequer for the time being, or to any Officer appointed by him, or to the faid Commiffioners by this Act appointed or any of them, or to any Officer or Officers appointed by them, or any of them, in the Execution of the Powers of this Act; or fhall utter any fuch forged, counterfeited or altered Certificate or Certificates, Receipt or Receipts, knowing the fame to be forged, counterfeited or altered, with Intent to defraud His Majefty, his Heirs or Succeffors, or any Body or Bodies Politick or Corporate, or any Perfon whomfoever, then and in every fuch cafe, all and every Perfon or Persons so offending, and being thereof lawfully convicted, fhall be adjudged guilty of Felony, and fhall fuffer Death as in cafes of Felony without Benefit of Clergy.

LXXII. And be it further enacted, That in all cases where an Oath may be administered by this Act, it shall be lawful to adminifter an Affirmation in lieu thereof, as the cafe may require.

LXXIII. And be it further enacted, That this Act, or any of the Provifions thereof, may be altered, varied or repealed by any Ad or Acts to be paffed in this prefent Seffion of Parliament.

E Your Majesty's moft dutiful and loyal Subjects, the Commons of the United Kingdom, in Parliament aflembled, being defirous of making Provifion to fatisfy the Principal Sums contained in certain Exchequer Bills, now outstanding, to the Amount of Twelve Millions Sterling, have refolved, that all Perfons interested ⚫ in or entitled unto certain Exchequer Bills fhould be entitled, in refpect of the Principal Sums contained therein, to fuch Capital Stock in Annuities as are hereinafter mentioned, fubject to the • Provifions of this Act;' We Your Majefty's most faithful Commons, do therefore most humbly befeech Your Majefty that it may enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That every Perfon interested in or entitled unto any Exchequer Bill or Bills dated between the First Day of April One thousand eight hundred and ten, and the Sixteenth Day of March One thoufand eight hundred and eleven; who ceive Certificates fhall between the Twenty firft Day of March One thoufand eight hundred and eleven, and the Twenty feventh Day of March One thousand eight hundred and eleven, both inclufive, have carried the fame to the Office of the Paymasters of Exchequer Bills, unless the faid Principal Sum of Twelve Millions Sterling fhall have been
