Horse-Guards, May 28, 1813.-Ar a General Court-Martial, held in Lancaster Castle, on the 25th January, 1813, and continued by adjournments to the 12th February following, Lieutenant and Paymaster William Cockell, of the Wiltshire Regiment of Militia, was arraigned upon the undermentioned charges, viz.

1st. "For malversation in his Office as Paymaster, in having, between the 24th June 1811, and the 20th April 1812, embezzled and misapplied certain sums of the Public Money, amounting to 12381. 9s. or thereabouts."

2d. "In having, between the 15th June, 1811, and the 20th April, 1812, embezzled and misapplied certain sums as bounties, received from the County Subdivision Clerks, for Recruits, amounting to 7811. 2s. 6d. or thereabouts."

3d. "In having, between the 17th December, 1809, and the 25th December, 1811, embezzled and misapplied certain monies belonging to the Regimental Mess Fund, amounting to 2321. 19s. 3d. or thereabouts."

4th. "In having embezzled and misapplied the further sum of 751. 78. 7d. or thereabouts, belonging to the Regimental Contingent Fund."

Upon which Charges the Court came to the following decision :——

"The Court-Martial, after a most attentive consideration of the Evidence produced in support of the Charges preferred against Lieutenant and Paymaster Wm. Cockell of the Wiltshire Regiment of Militia, and of the Prisoner's Defence, find it proved, that on, and up to the 24th December, 1811, he had overdrawn the sum of One hundred and Fifty Nine Pounds Two Shillings and Fourpence Halfpenny, and that for the Service of the Month of January, 1812, he had further overdrawn beyond his Expenditure, the sum of Nine Hundred and Fifteen Pounds Nine Shillings and Sixpence Halfpenny, exclusive of the Income Tax, upon the Pay of the Officers between the periods of 25th June, 1811, and 24th January, 1812, which had been retained by him, but does not appear to have been remitted to the proper office."

"They are of opinion with regard to the First Charge, that he is Guilty of so much of the said Charge as is comprised in the finding of the above sums so overdrawn and due by him to the Public."

"They are of opinion, with regard to the Second Charge, that he is Guilty." "With regard to the Third Charge, that he is Guilty."

"With regard to the Fourth Charge, the Court find it proved that he has balances due to him from the Baggage Account, Arms Account, and Music Fund of the Regiment, amounting to the sum of Ninety-Six Pounds One Shilling and Seven Pence Halfpenny, and exceeding the balance charged against him on the Contingent Account; they do therefore find him Not Guilty, and Acquit him thereof."

"The Court-Martial do Sentence him, the said Lieut. and Paymaster Wm. Cockell, of the Wiltshire Regiment of Militia, to be Dismissed the Service, and to forfeit the Arrears due to him on Account of his Pay."

"The Court-Martial also find, that on, and up to the 24th December, 1811, there appears to have been entered upon the Regimental Books, balances due to the Prisoner from certain Companies, amounting to 6311. 11s. 9d. against which sum claimed by him, a set off has been subsequently made for money stated to have been received by him (exclusive of the sums in the present Charges) upon the Regimental Account, and not to have been issued or accounted for since."

"The Court would not consider themselves justified in giving credit upon their proceedings to the Prisoner for such balances, because the sums of Public Money which he had overdrawn and retained, ought to have been appropriated to other specific purposes, and because the claims set against them would involve the necessity of an opinion upon a subject not coming within the Charges now submitted to

their judgment, and for which they have not been furnished with the necessary Evidence."

"The Court-Martial cannot consistently, with the due discharge of their duty, terminate their proceedings without remarking that considerable difficulties have been presented in the course of their Investigation, by the indistinct, and in some instances, contradictory Evidence produced in support and explanation of the Charges; and they are bound to notice that the Money Concerns of the Regiment do appear to have been conducted for some years previously to the Arrest of the Paymaster in a manner extremely irregular and inaccurate, as the Pay Serjeants have been in the habit of drawing money and keeping the Accounts without the intervention of the Officers Commanding the Companies, from which circumstance, and the consequent disputes as to the Payment and Receipts of certain sums charged to have been paid and issued by the Prisoner, has arisen (in addition to those already noticed) the impracticability of finding on these proceedings, the just balances of these Companies to December 24, 1811, and of giving a judicial opinion upon the Credit which the Paymaster claims for them."

His Royal Highness the Prince Regent has been pleased, in the name and on the behalf of His Majesty, to approve and confirm the Finding and Sentence of the Court, subject to such investigation of the Accounts as will take place in the revision of Pay Lists by the Secretary at War.

The Commander-in-Chief directs that the Charges preferred against Lieutenant and Paymaster Wm. Cockell, of the Wiltshire Regiment of Militia, together with the Finding and Sentence of the Court, and the Prince Regent's approval thereof, shall be read at the head of every Regiment, and entered in the General Order Book. Horse-Guards, June 10.-Ar a General Court-Martial held at Orange-Grove Barracks, Trinidad, on the 11th November, 1812, Paymaster JOHN FILLINGHAM, of the Royal West India Rangers, was arraigned

1st. "For making away with or misapplying a Sum of Money, the Subsistence of Non-commissioned Officers and Soldiers of the Regiment, amounting, on the 24th of July, 1812, to Four Hundred and Sixty-Four Pounds Four Shillings sterling, more or less."

2d. "For misapplying, or detaining in his own hands, the Sum of Four Hundred and Seventy-Seven Pounds Nine Shillings and Nine-Pence Halfpenny sterling, more or less, under pretence of paying the same on account of Regimental Necessaries and Articles supplied to Officers and Men of the Regiment, and which Sum or Sums, he regularly, and monthly, charged in his abstracts against the subsistence of Officers, Non-commissioned Officers, and Privates."

The Court found him Guilty of the First Charge, and also on the Second, of embezzlement to the Amount of Three Hundred and One Pounds; Paymaster Fillingham was, therefore, sentenced to be dismissed, and ordered to make good deficiencies proved against him to the amount of Seven Hundred and Six Pounds. This Sentence was confirmed by the Prince Regent; leaving, however, the decision of the balance due from Paymaster Fillingham to the Public, liable to the revision of the Secretary at War.

DISPATCHES, of which the following are extracts, were this day received by Earl Bathurst from Brigadier-General Lyon.

Extract of a Letter from Brigadier-General Lyon, dated Hamburg, May 8, 1813. The advance of the different corps of the French army to the Elbe, rendered it necessary for the divisions of General Tettenborn, Dorenberg, and Czernicheff, to recross this river: they concentrated at Hamburg. On the 1st of May, General Sebastiani, with about 7000 infantry and 3000 cavalry, moved from Luneburg in the direction of Magdeburg. On the 4th, this corps arrived and halted at Salzwedel.

General Davoust, with about 10,000 men, including the division of Vandamme, occupies Luneburg, Harburg, and Stade; detaching small posts of unequal strength at intermediate points along the banks of the Elbe. On the move of General Sebastiani to his right, General Count Walmoden marched with the corps of Dorenberg and Czernicheff to Deumitz.

Extract of a Letter from Brig.-Gen. Lyon, dated Schwarzenbeck, May 11, 1813. A few hours after I had closed the letter which I had the honour of addressing to your Lordship on the 8th instant, the enemy attacked the posts on the island of Wilhelmsburg and Ochsenwerder, but I feel most happy in reporting they have been repulsed with considerable loss.

It appears that Marshal Davoust had collected from 5 to 6000 men in the vicinity of Harburg on the 8th instant. This force, with the exception of about 1500 men left in Harburg, was embarked at one o'clock in the morning of the 9th. Favoured by the ebb tide, and under cover of numerous batteries on the opposite shore, a landing was effected at Wilhelmsburg long before break of day. The number of troops stationed in this island did not exceed 1100 men, the enemy gained therefore in the first instance considerable ground, but on the arrival of a Mecklenburg battalion, which was ordered immediately to their support, he was advanced upon and driven back to the boats.

A battalion of Hanoverians, commanded by Major de Berger, and a Lubec battalion, marching from Bergadorf and Zouenspiker on Ochsenwerder to the assistance of a corps of 600 men stationed at this post, attacked the enemy with vigour and impetuosity on his right flank: this compelled him to retreat, and in falling back he set fire to all houses and mills in the line of his march.

The conduct of the corps under the orders of Major de Berjer has been described to me as most distinguished. It was my intention to have made a particular report on the very rapid progress in discipline which this corps has made, although so very recently formed for His Majesty's service; and it is with great satisfaction I can add, that their gallantry in the field is equally conspicuous.

Upon the advance of the enemy, a flag of truce was sent out by General Wagher, commanding the advanced-guard of the Danish army in Holstein, with a declaration, that the forces under his command would co-operate in the defence of Hamburg, should an attack be persevered in on that city. On the officer's return, and a continuation of the operations of the enemy, the Danish forces actually passed the frontier, and took up a position on the Hamburg-berg, with ten pieces of cannon, whilst a line of gun-boats was at the same time stationed for the defence of the port.

I am unacquainted with the loss the Allies have generally sustained in the late affair; it is estimated at about one hundred and fifty men and fifteen officers. I VOL. II.

have learnt with regret, that the Hanoverian battalion has suffered severely, two captains and eighty men being killed or wounded.

The enemy entered Cuxhaven on the 8th instant. The detachment of the vete. ran battalion, under the orders of Major Kenzinger, are safely embarked.

Downing-Street, May 19, 1813.

DISPATCHES, of which the following are a copy and an extract, have been this day received at Earl Bathurst's Office, addressed to his Lordship by Lieutenant-General Sir John Murray, dated Alcoy, 17th April, and Castalla, 30th of April, 1813. Extract of a Letter fron Lieutenant-General Sir John Murray, to Earl Bathurst, dated Alcoy, 17th April, 1813.

I have the honour of inclosing a copy of a dispatch, addressed this morning to the Marquis of Wellington. The army remains in the position of Alcoy.

Alcoy, 17th of April, 1813.—MY LORD, In my dispatch of the 14th instant, I had the honour to acquaint your Lordship that the army was on its march to Alcoy. In the course of the night I learned that the enemy had, by forced marches, occupied Onteniente and Mogente, and that he would reach San Felipe before me. As the troops were much fatigued, I halted on the 15th instant.

The loss of the enemy amounts fully to the number at which I have stated it.
