1st. "For sending a challenge by Lieut. G. Moore, of the North Mayo Militia, on or about the evening of the 14th of Nov. 1812, to Lieut. Kent, of the 21st Light Dragoons, stationed upon the recruiting service in Dublin, with intent to provoke him to fight a duel."

2d. "For scandalous and infamous conduct, unbecoming the character of an Officer and Gentleman, in assaulting Lieutenant KENT, of the 21st Light Dragoons, in the public streets, during the time of Divine Service, on or about Sunday, November 15, 1812, accompanied by the before-mentioned Lieutenant MOORE and several others, apparently officers, by coming up to the said Lieutenant KENT (who was in conversation with Captain HOLLIS, of the 18th Foot, at his brother-in-law's door, in Gloucester-Street) and, without the slightest provocation, striking a most violent blow, with a large stick, at Lieutenant KENT's head, whereby he received a severe contusion, which, for the moment, deprived him of recollection, being a gross violation of Civil Order, subversive of all Military Discipline, and in breach of the Articles of War."

Upon which charges the Court came to the following decision:

The Court, taking into their serious consideration all the evidence laid before them, and the matters urged by the Prisoner in his defence, do and the Prisoner, Captain PERSSE O'KEEFE BOULGER, guilty of the first charge, as above preferred against him. And the Court do find the Prisoner guilty of part of the second charge, in very improperly striking Lieutenant KENT, of the 21st Regiment of Light Dragoons, a violent blow on the head with a stick, on Sunday, the 15th of November last, about the hour of two o'clock.-But the Court do not find the Prisoner guilty of so striking Lieutenant KENT without provocation, or of acting in a scandalous, infamous manner, as charged against him, and do therefore acquit the Prisoner from those parts of said second charge. And the Court, in consequence of such their finding, do adjudge and sentence, that the Prisoner, Capt. PERSSE O'KEEFE BOULGER, shall be cashiered.

But the Court, from the peculiar circumstances of the case, and considering the continued provocation sustained by the Prisoner, and the highly bonourable evidence and testimonials adduced by him, as to his conduct and character, and also his long and distinguished services, do beg leave most humbly, and in the strongest manner, to recommend the Prisoner to the most gracious clemency of His Royal Highness the PRINCE REGENT."

I am to acquaint you, that the PRINCE REGENT was pleased, in the name and on behalf of His MAJESTY, to approve the finding and sentence of the Court: but under all the circumstances of the case, His ROYAL HIGHNESS was further pleased to extend his gracious clemency to the Prisoner, by giving effect to the recommendation of the Court, and to command that he, Captain BOULGER, should be restored to the functions of his Commission.-I am, &c.

A Court Martial was lately held at Wakefield, to try Lieut.-Col. Balfour, of the 2d, er Royal North British Dragoons, for having issued, in the Orderly book, on the 20th of March, a Regimental Order, authorising W. Weir, Quarter-Master, to supply the regiment with necessaries, interfering with the duty and responsibility imposed upon the Captains and Officers commanding troops; and for having, since the 20th of March, 1811, permitted the same W. Weir to make exorbitant charges on several articles to the dragoons, thereby deriving an unwarrantable and illegal

profit, or with conniving at his so doing. The Court were of opinion, that Colonel Balfour is guilty of both the charges, and sentenced him to be cashiered; and in General Orders, issued since from the Horse Guards, it is stated that the Prince Regent has confirmed the sentence of the Court. But His Royal Highness was pleased to explain, that as upon neither of the charges there appeared any thing to impute dishonourable or unworthy motives to Colonel Balfour-that in issuing the order of the 20th of March, 1811, he acted under a mistake, by a misconstruction of the real meaning of the Regulation-that his absence from his regiment, on account of ill health for many months, prevented his exerting the same watchfulness as he otherwise might have done-and that no representation having been made to him from the other officers during his absence, Colonel Balfour was ignorant of the articles having been overcharged by Quarter-Master Weir. Upon these grounds, and taking into consideration the length of Colonel Balfour's services, the Prince was pleased to consider him a fit object for clemency, and to command that he should be restored to the functions of his commission. He was further pleased to command that Colonel Balfour should be severely reprimanded, and admonished to be more observant to the rules and regulations of the service.
