be made for the more effectual preventing the fame for the future; be it therefore enacted by the King's most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Veffels taking Authority of the fame, That from and in Tobacco at after the Twenty fifth Day of March, any of the Plan- One thousand feven hundred and fifty tations, for two, when any Ship or Veffel whatsoTransportation into Great Bri-ever shall have taken in Tobacco at any tain, Officer of Port or Place whatsoever, within His the Cuftoms to Majesty's Plantations in America, in orgive the Mafter der to convey the fame from thence into a Manifeft of Great Britain (except fuch Tobacco as the Quantity, fhall be Water-borne before the faid with the Number and Tare of Twenty fifth Day of March, One thouthe Packages, fand feven hundred and fifty two) the Collector or Comptroller, or other Chief Officer, or any Two of them, employed in the Management of the Cuftoms, at fuch Port or other Place, where fuch Ship or Veffel fhall have taken in Tobacco, fhall, at and upon the clearing of every fuch Ship or Veffel by the proper Officer or Officers of the Cuftoms appointed for that Purpose, deliver to the Mafter, Commander, or other Per fon taking Charge of any fuch Ship a Veffel, a Manifeft or Content in Writ ing, under his and their Hands and Sea of Office, which shall contain a true A count of all the Tobacco loaden Board every fuch Ship or Veffel, wit the Number of Hogfheads, Cafks, Chef and other Packages containing the fame and the Quantity of the Tobacco com tained in each particular Hogfhead, Cal

thall be contained; and alfo fhall, at and to tranfmit and upon the clearing of every fuch Ship a Duplicate or Veffel, as aforefaid, immediately tranf- thereof to the mit a Duplicate of fuch Manifeft or Con- of the Cuftoms tent to the refpective Commiffiones of in Great Brithe Customs in Great Britain: And any tain, Collector, Comptroller, or other Chief Officer or Officers of the Customs at yany Port or Place in His Majefty's Plantations in America, who hall, at and upon the clearing of any Ship or Veffel having Tobacco loaden on Board her, as aforefaid, neglect or refufe to deliver to the Mafter, Commander, or other Perfon taking Charge of fuch Ship or Veffel, fuch Manifeft or Content as is herein before fpecified and directed; or who fhall not, at and upon the clearing any fuch Ship or Veffel, immediately tranfmit a Duplicate of fuch Mani eft or Content to the faid refpective Commilioners of the Cuftoms in Great Britain, hall forfeit and lofe the Sum of Two under Penalty undred Pounds, to be recovered in any of zoo 1. of His Majefty's Courts of Record at Westminster, or in the Court of Admialty in His Majefty's Plantations, where uch Offence thall be committed.

II. And be it further enacted by the Auhority aforefaid, That every Mafter, Commander, or other Perfon or Perfons aking Charge of any Ship or Veffel aving Tobacco loaden on Board as aforefaid,

aforefaid, at any Port or Place whatsoever in any of His Majefty's Plantations in America as aforefaid, fhall, upon Arrival at his Port of Difcharge in Great Britain, and at the Time that he makes his Report of his Ship at the Cuftom. houfe, deliver to the Collector of the Customs at the faid Port (who is hereby required and directed to deliver the fame to the Land-waiters appointed for the Delivery of fuch Ship or Veffel) the Manifeft or Content of the Lading of his Ship or Veffel which he received from the Collector, Comptroller, or other Chief Officer of the Customs at the Port or other Place in the Plantations where he took in his Lading; and if any Mafter, Commander, or other Perfon or Perfons taking Charge of any fuch Ship or Veffel, fall neglect or refufe to deliver fuch Manifeft or Content to the Collector of the Customs, at the Time he makes his Report of his Ship at the Cuftom-house, at the Port of his under Penalty Difcharge, he and they fhall forfeit and lofe the Sum of One hundred Pounds.

III. And be it further enacted by the Authority aforefaid, That the Land waiters appointed for the Delivery of every Ship or Veffel arriving at any Por or Place in Great Britain, from any f His Majefty's Plantations in America, having Tobacco on Board, her, fhall not fuffer any Part of the Tobacco on Board any Ship or Veffel to be landed, until they have from, and agreeable to the Manifeft delivered to them by the Col lector, entered into their respective Book (given them by the Directions of the Commiffione

Commiffioners of His Majefty's Customs for keeping Accounts of Goods by them delivered or fuffered to be delivered from on Board fuch Ships) the faid feveral and refpective Manifefts, Marks, Numbers, Weights, Tares, and Contents of the feveral fogfheads, Casks, Chefts, and other Packages, under the Penalty of

the Forfeiture of Fifty Pounds; and the Landing Mark faid Land-waiters are hereby authorized to be fet upon and required upon the Landing of any every Hogifuch Tobacco, to caufe fuch Landing head, &c. Mark to be fixed and fet upon every. IV. tical Tobacco, if unmanufactured, and every Part thereof, be shipped and exported in the Original Package, with the fame Marks in, and with which it was at firft imported into Great Britain, and no other, without any Alteration whatsoever being made in the Package (except fuch as fhall be occafioned by neceffary Cooperage for the Repair of the faid Package) or any other Tobacco being put therein, or any Part of the Tobacco being removed or taken out of the Package in which it was at firft imported (except only Ten Pounds Weight of Tobacco, which fhall be allowed to be taken out of each Hogfhead, Cask, Cafe, or other Package, after the fame is weighed at the Importation, as is now the PracPenalty of en- tice; and if any Perfon or Perfons whattering Tobacco foever fhall enter any Tobacco for ExforExportation portation, at any other Port or Place

than that at which the fame identical Toother Package, bacco was imported, or in any other Cask or Package than the fame, in which the fame unmanufactured Tobacco was Originally imported, or without the fame Marks, all fuch Tobacco fhall be forfeited, and no Drawback thereupon shall be paid, or if any fhall be paid, the fame ihall be repaid, and the Perfon who entered, or caufed the fame to be entered, thall forfeit the Sum of Two hundred Pounds; and whoever fhall knowingly export beyond the Seas any Hogshead, or other Package of Tobacco, out of which more than Ten Pounds Weight of Tobacco has been taken for Samples, he, the, and they, fo offending, fhall forfeit and lofe the Sum of Twenty Pounds
