and the Right Honourable Walter Earl of Ormonde and Offory, and his Traitees, in pursuance of an Act made in the Forty fixth 46 0.3. c. 94 Year of His prefent Majefty's Reign: And whereas, under and by • virtue of the faid Act and of the Provifions thereof, the faid Duty ⚫ of Prizage and Butlerage of Wines in Ireland, hath become and now is fully and abfolutely vefted in His Majefty, his Heirs andSucceffors, and it is expedient that the fame fhould be abolished;" Be it therefore enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after One Calendar Month Duty of Prizage from the paffing of this Act, the faid Duty of Prizage and Butlerage and Butlerage of Wines brought into all or any Port, Haven, Creek, River or other of Wines in Ire Place in Ireland, and all Compofitions, Duties and other Payments in lieu or on account of fuch Prizage and Butlerage of Wines in Ireland, or in any Part thereof, fhall ceafe, determine and be no longer payable; any Law, Ufage, Cuftom, Contract or other Matter to the contrary in any wife notwithstanding.

II. THEREAS by an Act, paffed in the Fiftieth Year of the 50 G. 3. c. 42. Reign of His prefent Majefty, intituled, An Act for con- § 9. folidating the Duties of Cuftoms for the Isle of Man, and for placing the fame under the Management of the Commiffioners of Cuftoms in England, all Sums of Money received under the Authority of that Act, the neceffary Charges of raifing and accounting for the fame excepted, are required to be remitted to the Receiver Ge⚫neral and Cashier of the Cuftoms in England, to be paid into the Receipt of His Majefty's Exchequer, and fuch Part thereof as fhall ⚫ remain after the neceflary Expences attending the Government of the faid Ile of Man, and the Adminiftration of Justice there, and all other Charges are from time to time defrayed, are directed to go to and make Part of the Confolidated Fund of Great Britain: And whereas great Inconvenience and Delay will attend this Mode of obtaining the requifite Sums of Money for defraying the faid Expences and Charges; in Remedy thereof, Be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this

prefent Parliament affembled, and by the Authority of the fame, That any of the Collectors of the Cuftoms in the Isle of Man appointed to receive the Duties impofed by the faid recited A&t shall, and he and they is and are hereby authorized and required, agreeably to fuch Directions as fhall from time to time be given for that Purpose by the Commiffioners of His Majesty's Cultoms in England, or any Four or more of them, to retain fuch Sum or Sums of Money in his or their Hands as may be fufficient to defray the neceffary Expences attending the Government of the faid Isle of Man, and the Administration of Juftice there, and other Charges incurred in the faid Ifle, which have heretofore been or may hereafter be deemed fit and proper Charges to be deducted from and paid out of the Duties of Customs collected in the faid Isle of Man, and alfo for the Purpose of defraying any Bounties that may be due by Law upon Herrings caught by the Inhabitants of the faid Isle of Man, and upon the Amount of the faid Expences, Charges and Bounties, being afcertained, the faid Commiffioners of His Majefty's Cuftoms in England, or any Four or more of them, are hereby authorized to direct the fame to be paid out of the faid Monies fo retained to fuch Carried to Con- Perfon or Perfons as may be entitled to receive the fame; and the Refidue of the faid Monies arifing from Duties of Cuftoms in the Hands of the faid Collectors, after paying fuch Expences, Charges and Bounties, fhall be remitted to the Receiver General of the Cuftoms in England, to be paid into the Receipt of His Majefty's Exchequer for the Purpose of being carried to the Confolidated Fund of Great Britain; any thing in the faid recited Act of the Fiftieth Year of the Reign of His faid Majefty, or any other A&t or Acts to the contrary thereof notwithstanding.

II. And whereas in the Schedule marked (A.) annexed to the faid recited Act, Goods, Wares and Merchandizes, not thereinbefore charged with Duty, imported from any Port or Place from whence fuch Goods may lawfully be imported into the Ifle of Man, ⚫ are charged with a Duty of Fifteen Pounds, and which said Fifteen Pounds was intended to be imposed for every One hundred Pounds of the Value thereof, but the Words for every One hundred Pounds of the Value thereof are omitted;' Be it enacted, That the faid Duty of Fifteen Pounds fhall be deemed to have been chargeable and fhall be charged upon every One hundred Pounds of the Value of Goods, Wares and Merchandizes, not thereinbefore charged with Duty, being imported from any Port or Place from whence fuch Goods may lawfully be imported into the faid Ife of Man; which fhall have been fo imported fince the Fifth Day of July One thoafand eight hundred and ten, or fhall hereafter be fo imported, notwithstanding the Words for every One hundred Pounds of the Value thereof were omitted in the faid Schedule.

An Act for abolishing the Superannuation Fund in the Department of the Customs, and for transferring the fame to the Head of Confolidated Cuftoms, and for authorifing the Payment of all retired Allowances on that Department out of Confolidated Customs. [10th June 1811.] HEREAS a Fund has long been established under the Management of the Commiffioners of His Majefty's Cuftoms in England, for the Benefit of aged and infirm or difabled Officers, called the Superannuation Fund, which has been ⚫ partly fupported by the Contributions of the Officers of the faid Revenue, and partly by the Application of the Fees paid in refpect of Offices in the Cuftoms vacant or abolished to that Purpose: And whereas the granting and paying Allowances or Compenfations in the nature of Superannuation or retired Allowance, or Reward to Perfons in respect of their having held any Public Office or Employment, or been engaged in any Public Service, is regulated and controlled by an Act of the laft Seffion of Parlia- 50 G. 3. c. 117. ment, intituled, An A&t to direct that Accounts of Increase and • Diminution of Public Salaries, Penfions and Allowances, ball be annually laid before Parliament, and to regulate and controul the granting and paying of fuch Salaries, Penfions and Allowances; and it being expedient that the faid Fund fhould be abolished, and that the Monies conftituting the fame whether invefted in the Public. Funds, or remaining in the Hands of any Perfon whomsoever as Monies received on account of Fees and Emoluments of Offices in the Customs vacant and abolished, or from Contributions to the faid Fund, fhould be carried to the Account of Confolidated Cuftoms, and be paid into the Receipt of the Exchequer under that Head, and that all Payments, Penfions and Superannuation, or retired Allowances, to Perfons in refpect of their having held any Office or Employment in the Customs, fhould in future be paid out of Confolidated Cuftoms, and be charged to the Account of Incidents of that Department;' Be it therefore enacted by the King's Moft Excellent Majefty, by and with the Advice and Con. fent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That, from and after the Fifth Day of January One thoufand eight Superannuation hundred and twelve, no Contribution or Subfcription shall be taken Fund abolished.

or received from any Officer or Perfon in the Service of His Majesty's Customs, on account or towards the Support of the faid Fund; and that, from and after the faid Fifth Day of January One thousand eight hundred and twelve, the faid Fund fhall be abolished, and that all Monies that have been received either as Contributions to the faid Fund, or as Fees or Emoluments of Offices in the Customs abolifhed and vacant, and which Monies have been either vefted in the Purchase of Stock standing in the Books of the Bank of England, in the Names of Richard Frewin, William Roe and Francis Fownes Luttrell, Efquires, Trustees of the faid Fund, or in the Names of Richard Frewin, William Roe and Auguftus Pechell, Efquires, or remain in the Hands of any Perfons or Perfon whatever, fhall be paid over to the Receiver General of His Majefty's Customs in England, and by him paid into the Receipt of the Exchequer under the Head of Confolidated Cuftoms, for which Purpose the faid Truftees are hereby authorized and required to fell the faid Stock, and that all Monies that shall or may have been received or may hereafter be received by any Perfon or Perfons whatever, as fuch Contributions and as Fees or Emoluments of Offices in the Customs abolished and vacant, and which shall remain in the Hands or may come into the Hands of any fuch Perfon or Perfons, fhall be paid to the Receiver General of His Majefty's Cuftoms in England, and by him paid. into the Receipt of the Exchequer under the Head of Confolidated Penfions and Al- Cuftoms; and that all Payments, Penfions and Superannuations, or lowances paid in retired Allowances to Perfons, in refpect of their having held any Office or Offices, or Employment or Employments in the Cuftoms, heretofore paid out of the faid Fund, or charged on the King's Share of Seizures, fhall be paid out of Confolidated Customs, and be charged to the Account of the Incidents of the Cuftoms; any Law, Cuftom or Ufage to the contrary notwithstanding.

II. And be it further enacted, That this Act may be varied, altered or repealed by any A& or Acts to be made in this prefent Seffion of Parliament.

An Act to grant additional Duties of Excife on Tobacco
manufactured in Ireland.

WE Your Majefty's mokt dutiful and loyal Subjects, the Com

mons of Great Britain and Ireland, in Parliament afsembled, towards railing the neceffary Supplies to defray Your Majefty's public Expences in Ireland, have freely and voluntarily refolved to give and grant unto Your Majesty the Duties of Excife hereinafter mentioned, and do moft humbly befeech Your Majefty that it may be enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, Additional Duty and by the Authority of the fame, That there fhall be raised, levied, on Tobacco ina- collected and paid unto His Majefty, his Heirs and Succeffors, for and upon every Pound Weight of Tobacco which, at any time from and after the First Day of June One thoufand eight hundred and eleven, fhall be manufactured in Ireland in any manner, to be charged on the Perfon manufacturing the fame or taking any Part

thereof out of the original Package, for the whole Quantity contained in fuch Package (as expreffed in the Permit by virtue of which the Package was conveyed to the Manufacturer) at the time when the fame fhall be opened, an Excife Duty of Eight Pence British Currency, in addition to all other Duties of Customs or Excife now payable on any fuch Tobacco, under or by virtue of any Act or Acts in force in Ireland.

II. And be it further enacted, That the faid Inland or Excife Duty payable on Duty on Tobacco impofed by this A&t fhall be payable on all To- Tobacco not bacco not taken out of the original Package which fhall be in the Hands of any Manufacturer or Manufacturers or other Perfon or Perfons in Ireland at any time on or after the faid First Day of June One thoufand eight hundred and eleven, and fhall be a Charge on fuch Manufacturer or Manufacturers, or on the Perfon or Perfons taking fuch Tobacco out of the original Package, at the time when fuch Tobacco or any Part thereof shall be fo taken out; and the Surveyors, Gaugers or other Officers of the Revenue, fhall, within Ten Days after the paffing of this A&t, make Return or Reports in Writing to the Collectors in their refpective Districts of fuch Duty as fhall have then become due and payable by virtue of this Act, and of the Perfons chargeable there with in fuch District re fpectively; and that fuch Returns or Reports fhall be a Charge on all fuch Perfons, and fhall be paid by fuch Perfons to the Collector of the District within Seven Days after any fuch Return or Report, or in Default thereof all fuch Tobacco fhall be forfeited and feized, Penalty. and every Manufacturer or Perfon who fhall make Default therein fhall, for every fuch Default, forfeit the Sum of Fifty Pounds, and alfo One Shilling for every Pound Weight of Tobacco contained in fuch original Package.

III. And be it further enacted, That all Monies arifing from the Duty carried to Duties by this Act granted, the neceffary Charges of collecting and Confolidated paying the fame being deducted, fhall be carried to and made Part of the Confolidated Fund of Ireland.

IV. And be it further enacted, That the feveral Duties by this Act granted and made payable, and all Penalties and Forfeitures under this Act, fhall be raifed, levied, collected, paid, sued for, recovered and applied in fuch manner, and under fuch Powers and Authorities, and by fuch ways and methods, and according to fuch Rules and Directions, and under fuch Penalties and Forfeitures, as are appointed, directed and expreffed for the railing, collecting, paying, levying, allowing and managing any Duties, or for the Recovery of any Penalties or Forfeitures, in and by an Act made in Ireland in the Fourteenth and Fifteenth Years of His late Majefty King 14 & 15 Car. 2. (I.) Self. 4. Charles the Second, intituled, An Act for fettling the Excife or new Impoft upon His Majefty, his Heirs or Succeffors, according to the Book of Rates therein inferted; or in and by an Act made in the Forty fixth Year of His prefent Majefty's Reign, intituled, An Aa 46 G. 3. c. 106. to provide for the better Execution of the feveral Ads relating to the Revenues, Matters and Things under the Management of the Com. miffioners of Customs and Port Duties, and of the Commiffioners of Inland Excife and Taxes in Ireland; or in or by any other Act or Acts in force in Ireland, relating to the Revenue of Customs and Excife, or either of them, as fully and effectually to all Intents and Purposes
