An Act for repealing the Hat Duty in Great Britain.
[15th June 1811.]

HEREAS by an Act paffed in the Forty fourth Year of 44 G. 3. c. 98.
His prefent Majesty's Reign, intituled, An Act to repeal

the feveral Duties under the Commiffioners for managing the Duties upon flumped Vellum, Parchment and Paper, in Great Britain, and to grant new and additional Duties in lien thereof, certain Stamp Duties were impofed upon Hats and upon Licences for vending Hats by Retail, which it is expedient fhould now be repealed: May it therefore pleafe Your Majetty that it enacted; and be it enacted by the King's Moit Excellent Majefty, may be by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from aud after the Fifth Day of Duties on Hats July One thoufand eight hundred and eleven, the faid Duties on Hats and Licences for and on Licences for vending Hats by Retail, granted by the faid vending Hats to Act, fhall ceafe and determine, and all Powers and Provifions contained in the faid Act, and in any other Act or Acts of Parliament for the railing, levying, collecting or fecuring of the faid Duties, fhall be and the fame are hereby from thenceforth repealed; fave and except fo far as regards fuch of the faid Duties, or io much and fuch Parts thereof, as thall have become due or payable, or ought to have been paid, and all fuch Penalties and Forfeitures for Offences relating to the fame Duties, or any of them, as fhall have been incurred before or upon the faid Fifth Day of July.

II. And be it further enacted, That it fhall be lawful for all Dealers Dealers in Hat Linings, and for al licented Dealers in Hats, who liver up to Commay defhall, on the Sixth Day of July One thoufand eight hundred and milioners Hat eleven, be poifeffled of any Hat Linings duly ftamped for denoting the Duties on Hats, and which shall not have been used, or worn, or Linings duly fold with any Hat, to deliver the fame to the Commiffioners of Stamps, in order that the Stamps thereon may be cancelled; and on Commiffioners due Proof being made to the Satisfaction of the faid Commiffioners, on being fatisor the major Part of them, by Affidavit or folemn Affirmation made fied that Hat before the faid Commiflioners, or any One or more of them, or be- Linings had not fore a Master in Chancery Ordinary or Extraordinary, (who are hereby refpectively authorized to take the fame, and adminifter the proper Oath or Affirmation for that Purpose) that fuch Hat Linings had not been used, or worn, or fold with any Hat, and that the Poffeffors thereof had bona fide paid, or then stood bound or liable to pay the Duties marked thereon, and of all such other Circumstances as the faid Commiffioners or the major Part of them fhall in their Difcretion judge neceffary for the Purpose of preventing Frauds, it fhall be lawful for the faid Commiffioners, in all Cafes where the Poffeffors of fuch Hat Linings fhall have a Credit Account open with the Stamp Office, to allow the Amount of the Duties marked on fuch Hat Linings, in Reduction of their respective Debts; and in all

cafes where the Poffeffors fhall not have a Credit Account open with the Stamp Office, to return to them the Amount of the Ďuties marked on fuch Hat Linings, first deducting the Discount which fhall have been allowed for or in refpect of fuch Duties: Provided always, that no fuch Allowance or Return of Duties fhall be made, unlefs the fame shall be claimed within Six Calendar Months after the faid Fifth Day of July.

III. And be it further enacted, That it fhall be lawful for the faid Commiffioners, or the major Part of them, to authorize any of the Distributors of Stamps in the Country, to receive such Hat Linings from any fuch Dealers as aforefaid, refident within their refpective Diftricts, and thereupon to do all or any fuch Acts refpecting the fame as the faid Commiffioners themselves are hereby autho

rized to do.

IV. And be it further enacted, That if any Perfon making any fuch Affidavit or Affirmation as aforefaid fhall knowingly and wilfully make a falfe Oath or Affirmation of or concerning any of the Matters to be therein specified and fet forth, every Perfon fo offending, and being thereof lawfully convicted, fhall be subject and liable to fuch Pains and Penalties as by any Law now in force Perfons con. victed of wilful and corrupt Perjury are fubject and liable to.

An Act for the Abolition and Regulation of certain Offices in
the Customs.
[15th June 1811.]
WHEREAS by an A&t paffed in the Thirty eighth Year
of the Reign of His prefent Majefty, in tituled, An A&
for abolifbing certain Offices in the Culloms, and for regulating certain
other Offices therein, and for applying the Fees which have been received
from vacant Offices towards the Augmentation of the Superannuation
Fund; and by an A&t, paffed in the Forty eighth Year of the
Reign of His faid prefent Majefty, intituled, An Ad for abolishing
the Office of Surveyor of Subfidies and Petty Cufloms in the Port of
. London, certain Offices in the Cuftoms were directed to be wholly
، abolifhed, as the fame fhould become vacant, and certain other
• Offices were also directed to be abolished in Part when they should
become vacant; and that fuch of the respective Duties as fhould
be deemed useful and neceffary fhould be continued and regulated :
And whereas many of the Offices enumerated in the faid first recited
Act have become vacant, and been abolished under the said Act,
and it is expedient to make further Provifion for the Abolition and
Regulation of certain Offices in the Cuftoms: And whereas by an
Act paffed in the Forty fixth Year of the Reign of His faid pre-
fent Majefty, intituled, An At for abolishing Fees received by certain
Officers and other Perfons employed in the Service of the Cuftoms in
the Port of London, and for regulating the Attendance of Officers
and others fo employed, the Fees, Perquifites and Gratuities paid to
⚫ certain Officers, Clerks and Perfons employed in the Service of the
Cuftoms in the Port of London were wholly abolished: And whereas
by an Act paffed in the Forty feventh Year of the Reign of His
faid prefent Majefty, intituled, An A& to extend the Provifions of
an A made in the laft Seffion of Parliament, for abolishing Fees-

of the Cuftoms in the Port of London, and for regulating the Attend•ance of Officers and others fo employed, to the Gut Ports, and to ap"propriate the Fees of certain abolished and vacant Offices in the Cufloms to the Superannuation Fund, the Lords Commiffioners of His Majefty's Treasury were authorized to extend the Provifions of the faid laft recited Act to any of the other Ports in Great Britain, and which Provifions have been accordingly fo extended to several of the Ports in Great Britain, and to certain Officers of the Cuftoms employed in fuch Ports: And whereas it is expedient, in order to give full, general and immediate Effect to the good Purposes intended by the faid recited Acts of the Thirty eighth and Forty eighth Years of His prefent Majefty's Reign, that fuch of the Offices in the Customs as are by the faid Acts directed to be abolished when they become vacant, which have not yet become vacant, should be abolished or regulated; and alfo that all Fees, Perquifites and Gratuities received by Officers, Clerks or other Perfons employed in the Service of the Cuftoms, as well in the feveral Out Ports in Great Britain as in the Port of London, fhould be abolifhed;' May it therefore please Your Majefty that it may be enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and

are hereby abolished; and fuch of the Duties executed in the faid Neceffary Duties Offices as fhall be deemed to be neceffary and ufeful, fhall continue to continue. to be executed and performed according to fuch Regulations, and by such Persons, and in fuch manner as fhall be appointed under the Provifions of this Act; and that from and after the faid Fifth Day of Offices in Table January One thoufand eight hundred and twelve, the feveral Offices enumerated or described in the Table to this Act annexed, marked transferred to (C.) the Duties whereof are in Part neceflary, and which Duties other Offices. may, without Inconvenience to the Public Service, be transferred to and executed in certain other Offices of the Cuftoms, fhall, as far as the fame or any of them relate to the Port of London, be and the fame are hereby abolished, and the Duties thereof fhall he transferred to and executed in other Offices, and by fuch Perfons, and in fuch manner as shall be directed under the Provifions of this A&. III. And be it further enacted, That all Perfons who fhall or fons appointed to may be appointed under the Provilions of this Act to execute any of the Duties of any of the Offices or Employments enumerated and defcribed in the Tables hereunto annexed, marked (B.) and (C.) fhall have the fame Powers and Authorities to all intents and purpofes, to execute and perform fuch Duties refpectively, except as far as the fame be by any Order or Regulation made as to any fuch Duties under the Provifions of this Act, as fuch Perfons would have had if they had been appointed to fuch Offices or Employments refpectively before the Abolition of fuch Offices, and all fuch Powers and Authorities fhall remain in full Force and Effect for the Execu tion of all fuch Duties as fhall be fo continued and regulated under and fubject to the Reftrictions and Regulations contained in or made under the Provifions of this Act.

IV. And be it further enacted, That it fhall be lawful for the Lords Commiffioners of His Majefty's Treafurv for the time being, or any Three or more of them, to direct fuch Salaries to be paid to the feveral Perfons who fhall be fo appointed to execute any of the Duties of any or either of the Offices or Employments enumerated or defcribed in the faid Tables hereunto annexed, marked (B.) and (C.) as they the faid Lords Commiffioners of His Majefty's Treasury fhall think fit.

• V. And whereas it is reaf nable and proper that the several Per fons holding any of the Offices enumerated or defcribed in any or either of the faid Tables annexed to this Act, marked (A.) (B.) and (C.) and which Offices are hereby directed to he abolished, fhould receive a fair and adequate Compenfation for the Lofs which they may refpectively fuftain by the Abolition of their feveral Offices, and the Salaries, Fees, Perquifites and Emoluments apper. taining thereto;' Be it therefore further enacted, That it fhall be lawful for the Lords Commiffioners of His Majefty's Treasury for the time being, or any Three or more of them, to order fuch annual Compenfations to be made to every Perfon holding or having any Intereft in any Office enumerated or defcribed in either or any of the faid Tables, marked (A.) (B.) and (C.) hereby directed to be abolished, as on due Examination and Enquiry fhall appear to the faid Lords Commiffioners of His Majefty's Treasury to be just and reasonable; fuch Compenfation to be paid and to continue during the Lives of fuch Perfons refpectively, or during the Continuance of their feveral and refpective Rights and Interefts therein.

VI. And be it further enacted, That on the Abolition of any of the Offices enumerated or defcribed in the faid Tables hereunto annexed, marked (A.) and (C.) it fhall and may be lawful for the Lords Commiffioners of His Majefty's Treasury for the time being, or any Three or more of them, to make fuch just and reasonable Compenfation as they on due Examination and Enquiry fhall in their

Judgment think proper, to the Deputy or Deputies, Clerk or Clerks, or to any other Perfon or Perfons who, on and immediately before the faid Fifth Day of January One thoufand eight hundred and twelve, was or were employed in fuch Office fo abolished as aforefaid. • VII. And whereas the Office of Collector Outwards in the Port of London was, in the Year One thoufand feven hundred and eighty two, held by George late Duke of Manchester, for the Term of his Life and the Life of his Brother Charles Greville Montagu, commonly called Lord Charles Greville Montagu, by Letters Patent, and Letters Patent were prepared in the fame Year to pass the Great Seal, on a Surrender of the then exifting Patent by the faid late Duke, granting the faid Office to him, his Executors, Adminiftrators or Affigns, for and during his natural Life, and the natural Lives of William now Duke of Manchester, and Lord • Frederick Montagu, his Sons, in pursuance of His Majefty's War⚫rant for that Purpose, which Letters Patent did not pass the Great Seal, but the Profits and Emoluments of the faid Office have been ever fince enjoyed by the faid George late Duke of Manchester and his Family, in the fame manner as if fuch Letters Patent had been

and Emoluments due to the Collector Outwards in the Port of London, fhould continue to be received and taken in fuch and the like manner, and to the like Amount, and that the fame Perfons fhould be entitled to the Profits of the faid Office, as if Letters Patent for granting the faid Office had been perfected;' Be it therefore enacted, That the Compenfation or Allowance authorized to be Compenfation to made and granted by the Lords of the Treasury upon the Abolition the Duke of of the faid Office of Collector Outwards in the Port of London fhall Manchester and be paid to and for the Ufe of fuch Perfon or Perfons as at the time of paffing of this Act fhall be, or would from time to time hereafter be, legally entitled to demand and receive the Profits and Emoluments of the faid Office of Collector Outwards in the faid Port of London, in pursuance of the faid recited Act of the Thirty eighth Year of the Reign of His prefent Majefty, if fuch Office had not been abolished by this Act, and to no other Perfon or Perfons whatsoever.

VIII. And whereas the Office of Comptroller of the Cuftoms in Letters Patent the Port of London was, by Letters Patent dated the Twenty fixth Aug. 26, 1778. Day of Auguft One thousand feven hundred and feventy eight, granted to Francis then Earl of Guilford, and his Heirs, during the Lives of Francis North and Frederick North, Sons of Sir Frederick North commonly called Lord North, and the Life of the longeft Liver of them; and the faid Francis Earl of Guilford, by Will dated the Tenth Day of April One thoufand feven hundred and eighty two, gave and bequeathed the Reverfionary Grant of the faid Office to Sir Frederick North, commonly called Lord North, afterwards Earl of Guilford, his Executors, Adminiftrators and Affigns, who devifed and bequeathed his Reverfionary Grant therein unto his Sons Francis and Frederick North, and unto his Daughters Lady Katharine Ann Douglas, Lady Ann North and Lady Charlotte North, their Heirs, Executors, Adminiftrators and • Affigns,
