9. E it remembered, that A. B. on, &c. comes before me J. S. Efq; one of his Majefly's Juftices, &c. and then and there makes Oath, that C. D. on, &c. laft paft, did fell ten Bubels of Wheat in a Bufhel or Measure not being agreeable to the Standard in his Majesty's Exchequer, but less than the same, contrary to the Statutes. I do therefore adjudge him the faid C. D. guilty of the faid Offence, and convicted thereof as the Laws direct. Given, &c.

Indictment against a Constable for an Escape.

HE Jurors, and fo forth, That whereas one A. B. late of K. in the County aforefaid, Hufbandman, was taken and arrefted for felonioufly ftealing a Horfe of one R. B. and afterwards, to wit, the 30th Day of April in the Year, and fo forth, as aforesaid, was committed by J. S. Efq; one of the Justices of our faid Lord the King, for keeping the Peace in the County aforesaid, to the Cuftody of R. G. the Conftable of the Town aforefaid, to be carried to the Gaol in the County aforefaid, and that the faid R. G. then and there had the faid A. B. in his Cuftody for the faid Felony; and that afterwards, the faid 30th Day of April in the Year aforefaid, at the faid L. in the County aforefaid, be the faid R. G. voluntarily and feloniously permitted the faid A. B. to go at large from the Cuftody of the faid R. G. against the Peace of our Lord the King, his Crown and Dignity.

N. B. In an Indictment against a Constable for refusing to execute a Justice of Peace his Warrant, the Indictment muft fet forth the Nature and Tenor of the Warrant, or else 'tis not good. 1 Vent. 325.

Indictment against a Conftable for not raifing Hue and Cry.

and fo forth, at H. in the County of S. certain Malefactors by Force and Arms, did make an Assault upon R. N. Yeoman, and five Pounds of Money numbered as the proper Money of the faid R. N. then and there found, feloniously did take and carry away; bereupon the faid R. N. inftantly the fame Day and Year afore

faid, came to the Town of B. in the County aforefaid; and then and there gave Notice to one J. O. being the then Conftable of the faid Town of B. that the faid Malefactors had committed the faid Felony in Manner and Form aforefaid; and then and there required the faid J. O. to levy fresh Hue and Cry against the faid Malefadors, and that he would command the Inhabitants of the faid Town of B. to profecute fuch Hue and Cry, as of Right and by the Law of the Land they ought to profecute; yet the faid J. O. not at all minding the due Execution of his Office in this Behalf, did not levy the faid Hue and Cry, nor command the faid Inhabitants immediately to profecute the faid Hue and Cry; but then and there totally refused and neglected to do this, to the ill Example of others of his Majefy's Subjects, and against the Peace of our faid Lord the King that now is, his Crown and Dignity, and against the Form of the Statute in that Cafe made and provided.

Indictment against those who refuse to affist a Constable to apprehend a Felon.

HE Jurors, and fo forth, That R. G. of I H. in the faid County, Labourer, on the Day, and fo forth, at H. aforefaid, in the County aforefaid, feloniously did take and lead away one Cow of the Goods and Chattels of one G. E. and whereas J. O. Conftable of the Town of H. aforefaid, in the Day and Year aforefaid, at H. aforefaid, did command and require E. P. of H. aforesaid, and G. P. of the fame, Yeomen, to help him the faid J. O. then being Conftable of H. aforesaid, to take and arreft the faid Felon for the Felony aforefaid; yet the faid E. P. and G. B. the Day and Year aforefaid, at H. aforesaid, did altogether refuse, and each of them did refufe to do it, in Contempt of our Sovereign Lord the King that now is, and against the Peace, and fo forth.

The like may be against those who refufe to follow the Hue and Cry, being commanded by the Conftable, or for refufing to affift a Conftable, to convey Prifoners to the Gaol, or to bring them before a Juftice of Peace, &c.

Churchwardens, Conftables, and all other Parish Officers ought to take Notice of the following Refolution of the House of Commons.

Mar. 23. 1696. Declared and refolved, that no Member of this Houfe hath any Privilege against Payment of any Aids, Supplies, or 'Tax granted to his Majefty, or any Parish Duties.
